The Services are not intended for distribution where such use would be contrary to law or require us to register in another jurisdiction. Those who access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws.

The Services are not tailored to comply with industry-specific regulations (HIPAA, FISMA, etc.) and may not be used in a way that would violate the Gramm-Leach-Bliley Act (GLBA).

Our intellectual property

We own or are the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the "Content"), as well as trademarks, service marks, and logos (the "Marks"). Our Content and Marks are protected by copyright and trademark laws in the United States and around the world. The Content and Marks are provided "AS IS" for your internal business purpose only.

Your use of our Services

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and download or print Content for your internal business purpose only. No part of the Services, Content, or Marks may be copied, reproduced, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our express prior written permission. We reserve all rights not expressly granted. Any breach of these Intellectual Property Rights will terminate your right to use our Services immediately.

Your submissions

By sending us Submissions (questions, feedback, suggestions), you assign to us all intellectual property rights in such Submission. You are responsible for what you post or upload — you confirm Submissions are original, not confidential, and do not violate any third-party rights or applicable law.

By using the Services, you represent and warrant that: (1) all registration information you submit is true, accurate, current, and complete; (2) you will maintain the accuracy of such information; (3) you have the legal capacity to comply with these Legal Terms; (4) you are not a minor, or if a minor, you have parental permission; (5) you will not access the Services through automated or non-human means; (6) you will not use the Services for any illegal or unauthorized purpose; and (7) your use will not violate any applicable law or regulation.

If you provide information that is untrue, inaccurate, or incomplete, we have the right to suspend or terminate your account.

You may be required to register to use the Services. You agree to keep your password confidential and are responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username we determine to be inappropriate, obscene, or otherwise objectionable.

We accept the following forms of payment: Visa, Mastercard, PayPal. You agree to provide current, complete, and accurate purchase and account information. All payments shall be in US dollars. We reserve the right to refuse any order and to correct any pricing errors.

Billing and Renewal

Your subscription will continue and automatically renew unless canceled. You consent to our charging your payment method on a recurring monthly basis.

Free Trial

We offer a 14-day free trial to new users. The account will not be charged and the subscription will be suspended until upgraded to a paid version at the end of the free trial.

Cancellation

Fee Changes

We may change subscription fees from time to time and will communicate price changes in accordance with applicable law.

You may not access or use the Services for any purpose other than that for which we make them available. As a user, you agree not to:

• —Systematically retrieve data to create a collection, compilation, or database without written permission.
• —Trick, defraud, or mislead us or other users, especially to learn sensitive account information.
• —Circumvent, disable, or interfere with security-related features of the Services.
• —Disparage, tarnish, or otherwise harm us or the Services.
• —Use information from the Services to harass, abuse, or harm another person.
• —Make improper use of our support services or submit false reports of abuse or misconduct.
• —Use the Services in a manner inconsistent with any applicable laws or regulations.
• —Upload or transmit viruses, Trojan horses, or other malicious material.
• —Engage in any automated use of the system, including data mining or scraping scripts.
• —Attempt to impersonate another user or person.
• —Interfere with, disrupt, or create an undue burden on the Services.
• —Copy or adapt the Services' software, including Flash, PHP, HTML, JavaScript, or other code.
• —Decipher, decompile, disassemble, or reverse engineer any of the Services' software.
• —Use the Services as part of any effort to compete with us or for commercial enterprise.
• —Sell or otherwise transfer your profile.
• —Use the Services to conduct phishing simulations on individuals or organizations without their explicit written authorization.
• —Use the Services for any malicious, fraudulent, or unauthorized cybersecurity testing.
• —Upload employee data belonging to organizations you do not own or are not authorized to represent.
• —Attempt to use phishing templates or campaign results to cause actual harm, financial loss, or reputational damage to any individual.
• —Share, resell, or redistribute phishing templates, campaign data, or any content generated by the platform to third parties.
• —Use the Services to target individuals outside of your own organization's workforce.

The Services do not currently offer users the ability to submit or post public content. If we provide such opportunity in the future, any Contributions you transmit may be treated in accordance with our Privacy Policy. You represent and warrant that any Contributions are original, do not infringe third-party rights, are not false, misleading, or otherwise objectionable, and do not violate any applicable law.

We may access, store, process, and use any information and personal data that you provide in accordance with the Privacy Policy and your choices. By submitting suggestions or other feedback, you agree that we can use and share such feedback for any purpose without compensation to you. We do not assert any ownership over your Contributions — you retain full ownership and any associated intellectual property rights.

We allow advertisers to display their advertisements in certain areas of the Services. We simply provide the space for such advertisements and have no other relationship with advertisers.

We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against violators; (3) refuse, restrict, or limit the availability of any Contributions; (4) remove files and content that are excessive in size or burdensome to our systems; and (5) otherwise manage the Services to protect our rights and property.

We care about data privacy and security. Please review our Privacy Policy at decoy4u.com/privacy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms. The Services are hosted in the United States. If you access the Services from another region, you consent to having your data transferred to and processed in the United States.

These Legal Terms shall remain in full force and effect while you use the Services. WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO ANY PERSON FOR ANY REASON, INCLUDING FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE LEGAL TERMS. WE MAY TERMINATE YOUR USE OR DELETE YOUR ACCOUNT AND ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING.

If we terminate or suspend your account, you are prohibited from registering a new account under your name or any third party's name. We reserve the right to take appropriate legal action, including pursuing civil, criminal, and injunctive redress.

We reserve the right to change, modify, or remove the contents of the Services at any time at our sole discretion without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.

We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems resulting in interruptions, delays, or errors. Nothing in these Legal Terms obligates us to maintain and support the Services or supply any corrections, updates, or releases.

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

Informal Negotiations

The Parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.

Binding Arbitration

If the Parties are unable to resolve a Dispute through informal negotiations, the Dispute will be finally and exclusively resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA). YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. The arbitration will take place in New Castle, Delaware.

Restrictions

Any arbitration shall be limited to the Dispute between the Parties individually. No arbitration shall be joined with any other proceeding; there is no right for any Dispute to be arbitrated on a class-action basis.

Exceptions

The following Disputes are not subject to arbitration: (a) Disputes seeking to enforce intellectual property rights; (b) Disputes related to theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief. In no event shall any Dispute be commenced more than two (2) years after the cause of action arose.

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT AND WILL ASSUME NO LIABILITY FOR ERRORS, PERSONAL INJURY, UNAUTHORIZED ACCESS, INTERRUPTION, BUGS, VIRUSES, OR ERRORS OF ANY KIND. YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE LESSER OF THE AMOUNT PAID BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING OR $500.00 USD.

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand arising out of: (1) use of the Services; (2) breach of these Legal Terms; (3) any breach of your representations and warranties; (4) your violation of the rights of a third party; or (5) any overt harmful act toward any other user of the Services.

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services. You agree that we shall have no liability to you for any loss or corruption of any such data.

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS.

These Legal Terms constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision shall not operate as a waiver of such right or provision. We may assign any or all of our rights and obligations to others at any time. If any provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision is deemed severable from these Legal Terms and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Legal Terms.
